CHAPTER 371
An Act to amend and reenact § 15.1-536 of the Code of Virginia, relating to meetings of county governing bodies.
[S 386]
Approved April 6, 1994

Be it enacted by the General Assembly of Virginia:

1. That § 15.1-536 of the Code of Virginia is amended and reenacted as follows:

§ 15.1-536. Regular meetings.

Except as otherwise provided by law, the governing body of each county shall assemble at the courthouse of the county or at an office building owned by the county in an adjacent city, or at such other public place in the county as the governing body may prescribe, in regular session not less often than once each month upon such day or days as may be prescribed by order of the governing body.

The first meeting held after the newly elected members of the governing body shall have qualified and the first meeting held in the corresponding month of each succeeding year shall be known as the annual meeting, and the first meeting held in the sixth month thereafter shall be known as the semiannual meeting.

The days, times and places of regular meetings to be held during the ensuing twelve months shall be established at the annual meeting. Provided, however, that if the governing body subsequently shall prescribe any public place other than the courthouse, or any day or time other than that initially established, as a meeting day, place or time, the governing body shall pass a resolution as to such future meeting day, place or time and shall cause a copy of such resolution to be posted on the door of the courthouse and inserted in a newspaper having a general circulation in the county once a week for two successive weeks prior to the first such meeting at such other day, place or time. Provided further that should the day established by the governing body as the regular meeting day fall on any legal holiday, the meeting shall be held on the next following regular business day, without action of any kind by the governing body.

At its annual meeting the board may fix the day or days to which a regular meeting shall be continued if the chairman, or vice chairman if the chairman is unable to act, finds and declares that weather or other conditions are such that it is hazardous for board members to attend the regular meeting. Such finding shall be communicated to the members of the board and the press as promptly as possible. All hearings and other matters previously advertised shall be conducted at the continued meeting and no further advertisement is required.

Notwithstanding any other provision of law, a majority of the members of the governing body present at the prescribed day, time and place to attend any meeting held or to have been held pursuant to the provisions of this section shall constitute a quorum for the purpose of adjourning such meeting from day to day or from time to time or from place to place, not beyond the time fixed for the next regular meeting, until the business before the governing body is completed.
