An Act to amend and reenact § 40 of Chapter 343 of the Acts of Assembly of 1928, which provided a charter for the City of Lynchburg, relating to the sheriff.

Be it enacted by the General Assembly of Virginia:

1. That § 40 of Chapter 343 of the Acts of Assembly of 1928 is amended and reenacted as follows:

CHAPTER VII
JUDGE AND CLERK OF CIRCUIT COURT , COMMONWEALTH'S ATTORNEY, CLERK CITY TREASURER AND OTHER OFFICERS

§ 40. Judge and clerk of circuit court, Commonwealth's attorney, city treasurer, city sheriff and commissioner of revenue.

A. There shall be for said city a judge of the corporation circuit court, a Commonwealth's attorney, a clerk of the corporation circuit court, a treasurer, a sergeant sheriff, and a commissioner of the revenue, each of which shall be elected in the manner and at the time, and to hold office for the term prescribed by law; they shall respectively perform such duties, have such powers, and be liable to such penalties as may be prescribed by the laws of the State Commonwealth or the ordinances of the city, made in pursuance thereof; and for all services performed for said city by the treasurer or by the commissioner of revenue, or performed under any ordinance or resolution of the council, such officers shall receive such compensation as may from time to time be fixed by the council, which compensation may be either in the shape of salary or commissions as the council may determine.

B. Notwithstanding any provision of law to the contrary, the sheriff shall, upon the adoption of an ordinance by the city council, in addition to the other duties and responsibilities imposed upon him by general law, be responsible for the operation of the city jail, lockup facilities, receiving unit and court holding facilities.

2. That an emergency exists and this act is in force from its passage.
