Be it enacted by the General Assembly of Virginia:
1. That § 47.1-5.1 of the Code of Virginia is amended and reenacted as follows:
§ 47.1-5.1. Application for recommission.
Persons already commissioned as notaries public or electronic
notaries public pursuant to this title and who are submitting application for
recommission as a notary or electronic notary may submit applications to the
Secretary in person, by first-class mail, or online, provided online
applications contain electronic signatures, authorized by the Uniform
Electronic Transactions Act (§ 59.1-479 et seq.), provided online
applications contain electronic signatures, authorized by the Uniform
Electronic Transactions Act (§ 59.1-479 et seq.), as confirmation that the
application has been signed and sworn pursuant to § 47.1-5. No person
applying for recommission shall be required to include the oath of the
applicant required for commission by § 47.1-5, provided that such applicant is
in good standing as a notary public or electronic notary public, is not subject
to any investigation or proceeding, and has never been removed from office
pursuant to Chapter 5 (§ 47.1-24 et seq.).
