SUMMARY AS PASSED:
Administrative Process Act; Department of Wildlife Resources; guidance documents; endangered species. Directs that certain guidance documents developed and used by the Department of Wildlife Resources relating to threatened and endangered species shall expire on December 31, 2023, unless such documents are filed for publication with the Virginia Registrar of Regulations and made available for public comment pursuant to the Administrative Process Act (§ 2.2-4000 et seq.) by November 1, 2023.
SUMMARY AS PASSED HOUSE:
Administrative Process Act; Department of Wildlife Resources; guidance documents; endangered species. Clarifies that certain guidance documents developed and used by the Department of Wildlife Resources relating to threatened and endangered species shall expire on December 31, 2023, unless such documents are filed for publication with the Virginia Registrar of Regulations by August 1, 2023, and made available for public comment pursuant to Administrative Process Act (§ 2.2-4000 et seq.).
SUMMARY AS INTRODUCED:
Administrative Process Act; Department of Wildlife Resources; exemptions; endangered species. Clarifies that the Department of Wildlife Resources (the Department), in promulgating regulations and in all case decisions regarding endangered and threatened species, must comply with the provisions of the Administrative Process Act. The bill requires the Department to file its guidance documents relating to threatened and endangered species for publication with the Virginia Registrar of Regulations by August 1, 2023, and revoke or publish for comment such documents as provided in the bill by December 31, 2023.
