Be it enacted by the General Assembly of Virginia:

1. § 1. That the Board of Social Services shall amend 22VAC40-73, Standards for Licensed Assisted Living Facilities, for facilities with fewer than 25 residents to comply with the following requirements: (i) direct care staff shall be provided six months to complete the 40-hour direct care class approved by the Department of Social Services, complete any necessary cognitive training and, in cases in which another staff member on duty has cardiopulmonary resuscitation (CPR) certification, complete CPR and first aid certification; (ii) a person shall be considered to have met the necessary qualifications for a licensed administrator if the person has taken at least 30 credit hours of applicable postsecondary education from an institution of higher education and has three years of experience with adults with a disability or who are aged or infirm in a licensed facility; (iii) the minimum age requirement for staff shall be 16 years of age; and (iv) direct care staff shall be required to complete no more than 12 hours of annual training.
