23101422DWHEREAS, certain constitutional officers of the Commonwealth, including attorney for the Commonwealth, clerk of the circuit court, and sheriff, are established under Article VII, Section 4 of the Constitution of Virginia; and
WHEREAS, funding for the offices of constitutional officers is determined by a combination of state and local funding and varies by locality; and
WHEREAS, the Compensation Board plays an important role in determining a reasonable budget for the participation of the Commonwealth toward the total cost of office operations for constitutional officers; and
WHEREAS, the Commonwealth, its localities, and its constitutional officers will benefit from a comprehensive examination of Compensation Board funding of constitutional offices; now, therefore, be it
RESOLVED by the House of Delegates, the Senate concurring, That the Joint Legislative Audit and Review Commission be directed to study Compensation Board funding for the offices of certain constitutional officers.
In conducting its study, the Joint Legislative Audit and Review Commission shall review the trends and trajectory of general fund support in the state budget for the offices of attorney for the Commonwealth, clerk of the circuit court, and sheriff, the metrics by which support is determined, the equity of such state support considering the needs of the various localities, and the degree to which localities are supplementing the Commonwealth's funding.
All agencies of the Commonwealth shall provide assistance to the Joint Legislative Audit and Review Commission for this study, upon request.
The Joint Legislative Audit and Review Commission shall complete its meetings by November 30, 2023, and the director shall submit to the Division of Legislative Automated Systems an executive summary of its findings and recommendations no later than the first day of the 2024 Regular Session of the General Assembly. The executive summary shall state whether the Joint Legislative Audit and Review Commission intends to submit to the General Assembly and the Governor a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
