22100569DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 58.1-4006.1 as follows:
§ 58.1-4006.1. Use of the [ name of the
Commonwealth phrase "Virginia
is for Bettors" ] prohibited; civil penalty.
A. As used in this section, "gaming business" means any person who holds or has applied for a permit or license under the provisions of Article 2 (§ 58.1-4030 et seq.) or Chapter 41 (§ 58.1-4100 et seq.), or any affiliate thereof.
B. A gaming business is prohibited from using the [ name
of Virginia or the Commonwealth phrase "Virginia is for
Bettors" ] in an advertisement in association with its product or
service. Any gaming business that violates the provision of this section shall
be subject to a civil penalty of not more than $50,000. The Director shall
enforce the provisions of this section.
C. All civil penalties collected pursuant to this section shall accrue to the general fund.
