S.B. 180 Exhaust systems; excessive noise.

Patron: Saslaw

Exhaust systems; excessive noise. Prohibits any individual from operating a motor vehicle with a gross weight of 6,500 pounds or less with an exhaust system that emits noise in excess of 85 decibels. The bill also allows the governing body of any county, city, or town located within the Northern Virginia Planning District to provide by ordinance that no person shall operate any motor vehicle on a highway or on public or private property within 500 feet of any residential district unless such motor vehicle is equipped with an exhaust system of a type installed as standard equipment, or comparable to that designed for use on that particular vehicle or device as standard factory equipment, in good working order and in constant operation to prevent excessive noise.

A BILL to amend and reenact §§ 46.2-1047, 46.2-1049, 46.2-1051, and 46.2-1300 of the Code of Virginia and to amend the Code of Virginia by adding a section numbered 46.2-1049.1, relating to exhaust systems; excessive noise.

S.B. 220 State of good repair funds; bridges eligible for funding.

State of good repair funds. Makes bridges with a general condition rating of no greater than five eligible for state of good repair funding. Under current law, structurally deficient bridges and highways with deficient pavement conditions are eligible for state of good repair funds. The bill eliminates the minimum and maximum percentage of the state of good repair funds that each construction district can receive.

S.B. 277 DMV; applicants for driver's licenses, etc., to provide his race & ethnicity.

Department of Motor Vehicles; Virginia Community Policing Act; race and ethnicity data. Requires the Department of Motor Vehicles to require an applicant for an original driver's license, driver privilege card, special identification card with or without a photograph, and identification privilege card or the renewal or reissue of such license or card to provide his race and ethnicity. The bill prohibits displaying any such data in a readable form a credential issued by the Department and requires such data to be encoded in the barcode on the back of such license or card. The bill prohibits the release of such data to any entity other than the Department of State Police to be used exclusively for the Virginia Community Policing Act Database.

S.B. 339 Washington Metropolitan Area Transit Authority; alternate directors.

Washington Metropolitan Area Transit Authority; alternate directors. Repeals a provision of the 2018 mass transit funding legislation that requires the Commonwealth Transportation Board to withhold certain funding from the Washington Metropolitan Area Transit Authority if alternate directors of the Authority participate in or take action at a meeting at which the primary directors are present.

S.B. 368 Vehicle history report companies; notifications.

Vehicle history report companies; notifications. Requires vehicle history report companies, as defined in the bill, to notify a vehicle owner and lienholder, if any, if his vehicle has been deemed nonrepairable or any comparable term in the records of such company. The bill requires vehicle history report companies to establish and maintain a process for disputing such a designation and, if appropriate, having it corrected in a timely manner. The bill provides that a failure to notify the owner constitutes a violation of the Virginia Consumer Protection Act. The bill authorizes the Department of Motor Vehicles to release the name and address of the vehicle owner and lienholder for the purpose of such notification.

S.B. 445 Roadways; operation under HCA to operate instead under PPTA.

Commissioner of Highways; roadways operating under the Virginia Highway Corporation Act of 1988 to operate under the Public-Private Transportation Act of 1995. Directs the Commissioner of Highways to evaluate whether it is in the public interest for any roadway operated pursuant to the Virginia Highway Corporation Act of 1988 (HCA) to operate instead under the authority and requirements provided by the Public-Private Transportation Act of 1995 (PPTA). The bill authorizes the Commissioner, if he determines it is in the public interest for any such roadway to operate under the PPTA and if the Secretary of Transportation and the Transportation Public-Private Partnership Steering Committee concur, to negotiate and execute a new comprehensive agreement with the operator of such roadway to operate under the authority and requirements provided by the PPTA. The bill has an expiration date of January 1, 2024.

A BILL to direct the Commissioner of Highways to evaluate whether roadways operating under the Virginia Highway Corporation Act of 1988 should operate under the Public-Private Transportation Act of 1995.

S.B. 612 Highway use fee, mileage-based user fee program; program clarifications.

Highway use fee, mileage-based user fee program; program clarifications developed by the working group. Requires the Commissioner of the Department of Motor Vehicles to deny the registration or registration renewal of a participant in the mileage-based user fee program who has failed to pay the mileage-based user fee. The bill protects certain data collected for the mileage-based user fee program from disclosure. The bill directs the Commissioner to establish a process for issuing prorated refunds of mileage-based user fees to certain participants.

Towing. Adds various prohibitions and responsibilities for towing and recovery operators and tow truck drivers. The bill creates a private cause of action against towing and recovery operators, expands the authority of the Office of the Attorney General in enforcing towing laws, and provides that a violation of certain towing offenses is a violation of the Virginia Consumer Protection Act.

S.B. 706 Trucks; operation in certain weather conditions.

Trucks; operation in certain weather conditions. Requires the operators of trucks to stay in the right-most lane of any highway with two or more lanes in each direction and to not use cruise control or compression release engine brakes when driving in active snow, sleet, or freezing rain, or other inclement cold precipitation.

S.B. 708 Driving Decarbonization Program and Fund; created.

Driving Decarbonization Program and Fund. Establishes a driving decarbonization program and fund to assist developers with non-utility costs associated with the installation of electric vehicle charging stations. A developer would be eligible to grants of 50 to 70 percent of the non-utility costs, depending on where the charging station is located in the Commonwealth. The total amount of grants awarded in a fiscal year is capped at $20 million, with at least $5 million in grants reserved for charging stations located in historically economically distressed communities.

S.B. 733 Exempted vehicles; insurance.

Exempted vehicles; insurance. Requires motor vehicles, trailers, and semi-trailers exempted from the registration requirement to be covered by motor vehicle insurance or an umbrella or excess insurance policy. The bill requires the owner of any such motor vehicle, trailer, or semi-trailer to provide proof of insurance within 30 days when requested by a law-enforcement officer and provides that failure to do so is punishable as a traffic infraction by a fine of $600 to be paid into the Uninsured Motorists Fund.

Requires the Department of Motor Vehicles to, upon application therefor, authorize for use on antique motor vehicles and antique trailers license plates that are embossed with and are of the same year of issue as the model year of the antique motor vehicle or antique trailer on which they are to be displayed having the same number as license plates already authorized for use on another motor vehicle or trailer, provided that only one of such sets of license plates was manufactured in 1973 or thereafter and any other such license plates were manufactured prior to 1973 and are also embossed with and are of the same year of issue as the model year of the antique motor vehicle or antique trailer on which they are to be displayed.
