Energy performance-based contracts; roof replacement. Requires the acquisition of a roofing subcontractor through competitive negotiation if a contracting entity enters into an energy performance-based contract that involves roof replacement. Current law prohibits the inclusion of a roof replacement project as part of an energy performance-based contract.

Economic development; Virginia Business Ready Sites Program Fund created. Establishes the Virginia Business Ready Sites Program Fund (the Fund). The Fund would be administered by the Governor and the Virginia Economic Development Partnership Authority and would provide grants to political subdivisions to prepare sites for industrial or commercial development. The bill repeals existing law that created the Major Employment and Investment Project Site Planning Grant Fund and provides that any remaining funds would be allocated to the Fund. The bill also authorizes grants from the Virginia Brownfields Restoration and Economic Redevelopment Assistance Fund for site remediation and requires the prioritization of sites with potential for redevelopment and economic benefits to the surrounding community.

Virginia Land Conservation Foundation and Fund. Directs the Governor to include a $40 million recommended appropriation to the Virginia Land Conservation Fund in the budget bill or amendments thereto each year. Currently, the Governor is directed to include an amount based on a formula set forth in the Code. The bill makes various changes to the allocation and use of funds for grants from the Virginia Land Conservation Fund, including allowing grants to be made to state-recognized and federally recognized Virginia Indian Tribes, and requires that at least one nonlegislative citizen member of the Virginia Land Conservation Foundation Board of Trustees be a member of a state-recognized or federally recognized Virginia Indian Tribe.

Allows the Department of Environmental Quality to accelerate the release of nutrient credits generated by a stream restoration project if a qualified applicant, defined in the bill, provides sufficient bond to (i) provide a high degree of confidence that performance standards will be achieved and (ii) cover the cost of correcting a failure to achieve the performance standards.

Lower carbon concrete; report. Provides a performance bonus for contractors to utilize approved lower carbon concrete products in projects with the Department of General Services (DGS) and the Department of Transportation (VDOT). The bill directs the Department of Environmental Quality to develop, in conjunction with DGS and VDOT, the baseline for determining if a concrete product is lower carbon concrete. The bill requires VDOT and DGS to report annually to the Governor and the General Assembly concerning the use of the performance bonus. The bill also creates a nonrefundable tax credit for taxable years beginning on and after January 1, 2022, but before January 1, 2026, for certain technology implementation costs incurred by concrete producers in the production of lower carbon concrete equal to the amount actually paid by the producer for the technology implementation, up to a maximum of $5,000.

Authorizes the Virginia Port Authority, in awarding grants through the Waterway Maintenance Grant Program, to award a grant to a political subdivision or governing body for the dredging of a waterway channel with a bottom that is privately owned if such political subdivision or governing body holds a lease of such bottom with a term of 25 years or more.
