SUMMARY AS INTRODUCED:

Department of Medical Assistance Services; agreements with managed care organizations; requirements for hospice and home care providers. Directs the Department of Medical Assistance Services to include provisions in any agreement with a managed care organization related to communication of information to participating hospice and home care providers about specific requirements for participation in such managed care organization's provider network, including communicating changes to such requirements, developing an audit process for identifying violations of such requirements, and providing training and technical assistance regarding compliance with such requirements. The bill requires the managed care organization to provide an opportunity for a hospice or home care provider to correct any violations of such requirements that are not related to adherence to a plan of care and a process by which a finding by the managed care organization that a hospice or home care organization has violated such requirements may be appealed to the Department. The bill also directs the Department to develop a process for review of any appeal made of a finding by the managed care organization that a hospice or home care organization has violated requirements for participation in the managed care organization's provider network.
