SUMMARY AS INTRODUCED:
Board and Commissioner of Health; order; appeal; award. Provides that any person who operates a business in the Commonwealth that is forced to close as a result of any emergency order of the Board of Health or Commissioner of Health who contests such order and prevails on the merits of the case is entitled to recover from the Department of Health an amount equal to (i) two times the total amount of civil penalties levied against such person as a result of such order and (ii) $10,000 per day for each day that the business was closed as a result of such order.
