SENATE BILL NO. 5109 FLOOR AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by Senator Chafin on September 2, 2020) (Patron Prior to Substitute--Senator Chafin) A BILL to amend the Code of Virginia by adding a section numbered 32.1-45.5, relating to Commissioner of Health; nursing home and assisted living facility employees and residents; priority for testing; COVID-19 pandemic.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-45.5 as follows:

§ 32.1-45.5. Nursing home and assisted living facility residents and employees; priority for testing.

A. As used in this section:

"Assisted living facility" has the same meaning as set forth in § 63.2-100.

"Nursing home" has the same meaning as set forth in § 32.1-123.

B. The Commissioner shall ensure that residents and employees of any nursing home or assisted living facility receive first priority for any testing indicating the existence of the COVID-19 virus in the Commonwealth.
