2020 SPECIAL SESSION I
20200589DWHEREAS, Article I, Section 4 of the Constitution of the United States provides that the times of holding elections for United States Senators and Representatives is to be prescribed by the states, but it authorizes the Congress to make or alter such a state law; and
WHEREAS, Congress enacted legislation to establish the Tuesday next after the first Monday in November, in every even-numbered year, as the day of the election of Representatives in each state; and
WHEREAS, Congress enacted legislation to align the popular election of Senators with the biennial House elections; and
WHEREAS, Article II, Section 1, clause 4 of the Constitution of the United States authorizes the Congress to select the time for choosing presidential electors for the Electoral College and the day all states' electors vote for President and Vice President; and
WHEREAS, Congress enacted legislation to require the selection of presidential electors in each state on the Tuesday next after the first Monday in November, in every fourth year succeeding every election of a President and Vice President; and
WHEREAS, the Tuesday next after the first Monday in November this year, an even-numbered year and the fourth year succeeding the presidential election of 2016, is November 3, 2020, and
WHEREAS, the COVID-19 pandemic's disruption of nearly all aspects of life has given rise to discussion by some of a potential delay or postponement of the November 3, 2020, election; now, therefore, be it
RESOLVED by the House of Delegates, the Senate concurring, That the Congress of the United States be urged to not delay or postpone the federal elections scheduled for November 3, 2020; and, be it
RESOLVED FURTHER, That the Clerk of the House of Delegates transmit copies of this resolution to the Speaker of the United States House of Representatives, the President of the United States Senate, and the members of the Virginia Congressional Delegation so that they may be apprised of the sense of the General Assembly of Virginia in this matter.
