Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 8.01-223.3 as follows:

§ 8.01-223.3. Unconstitutional laws; attorney fees and costs.

In any litigation in which (i) the constitutionality of a law of the Commonwealth is at issue and (ii) the court finds that the law is unconstitutional, the Commonwealth shall reimburse the aggrieved party for attorney fees and costs.
