A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 27 of Title 54.1 a section numbered 54.1-2708.5, by adding in Article 1 of Chapter 29 of Title 54.1 a section numbered 54.1-2910.5, and by adding in Article 5 of Chapter 32 of Title 54.1 a section numbered 54.1-3225, relating to prescribing of opioids; required patient disclosures.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 27 of Title 54.1 a section numbered 54.1-2708.5, by adding in Article 1 of Chapter 29 of Title 54.1 a section numbered 54.1-2910.5, and by adding in Article 5 of Chapter 32 of Title 54.1 a section numbered 54.1-3225 as follows:

§ 54.1-2708.5. Prescribing of opioids; required patient disclosures.

Prior to prescribing an opioid, a dentist shall discuss with the patient or the patient's parent or guardian information regarding the prescribed opioid, including the risks of addiction and overdose associated with opioids; the dangers of taking opioids with alcohol, benzodiazepines, and other central nervous system depressants; the reasons why the prescription is necessary; and alternative treatments that may be available. The dentist shall include a notation in the patient's medical record indicating that these required patient disclosures were discussed.

§ 54.1-2910.5. Prescribing of opioids; required patient disclosures.

Prior to prescribing an opioid, a practitioner licensed under this chapter shall discuss with the patient or the patient's parent or guardian information regarding the prescribed opioid, including the risks of addiction and overdose associated with opioids; the dangers of taking opioids with alcohol, benzodiazepines, and other central nervous system depressants; the reasons why the prescription is necessary; and alternative treatments that may be available. The practitioner shall include a notation in the patient's medical record indicating that these required patient disclosures were discussed.

§ 54.1-3225. Prescribing of opioids; required patient disclosures.

Prior to prescribing an opioid, a TPA-certified optometrist shall discuss with the patient or the patient's parent or guardian information regarding the prescribed opioid, including the risks of addiction and overdose associated with opioids; the dangers of taking opioids with alcohol, benzodiazepines, and other central nervous system depressants; the reasons why the prescription is necessary; and alternative treatments that may be available. The TPA-certified optometrist shall include a notation in the patient's medical record indicating that these required patient disclosures were discussed.
