20102237DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 1 of Chapter 15 of Title 15.2 a section numbered 15.2-1512.5 as follows:
§ 15.2-1512.5. Authority of local government employees to issue summonses for [ misdemeanor ] violations of local ordinances.
Notwithstanding any other provision of law, a locality may
appoint and train local government employees to enforce local ordinances by
issuing summonses for [ misdemeanor ] violations of ordinances
that are within the [ purview scope ] of the
employee's employment. Such employees shall not have the power and authority of
constables at common law [ , but shall have the authority granted to
conservators of the peace pursuant to subsection B of § 19.2-74 ;
their power shall be limited to issuing such summonses in their locality ] .
