20103468DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-147.3 as follows:
§ 18.2-147.3. Throwing or depositing certain materials or substances on land used for agricultural purposes; penalty.
No person shall throw or deposit or cause to be deposited upon any land used for agricultural purposes any glass bottle, glass, nail, tack, wire, or can, or any other material or substance, that causes property damage of $200 or more to any machinery or motor vehicle being used in an agricultural operation on such land. A violation of this section is punishable as a Class 1 misdemeanor. Upon conviction of a violation of this section, the court shall order restitution to be made to the owner of the damaged machinery or motor vehicle for any loss caused by the violation.
