If a locality votes in the affirmative to remove, relocate, destroy, cover, or alter any monument or memorial on the locality's public property, the governing body shall first (i) petition the circuit court to order an advisory referendum to be held in accordance with the provisions of § 24.2-684 on the issue of such action, with a majority of the qualified voters voting thereon to approve the request for the proposed action, and, pending such approval, (ii) offer the monument or memorial for relocation and placement to any museum, historical society, local government, or military battlefield for a period of 180 days.

If a bona fide heritage or historical § 501(c)(3) organization in active status requests the memorial or monument within 180 days, the locality shall provide for the relocation of the memorial or monument to such private property of the organization as specified by that organization where it shall be publicly accessible. The heritage or historical § 501(c)(3) organization shall then preserve and maintain the monument or memorial in perpetuity at minimal or no cost to the public.
