SB 4009 Employment; incidents of workplace violence.

SUMMARY AS INTRODUCED:
Employment; incidents of workplace violence. Requires private employers, state agencies, local governments, local school boards, and public institutions of higher education, upon becoming aware of an incident of workplace violence, to (i) conduct an assessment of the likelihood that the offending employee may subject other individuals to future harm and (ii) report the incident of workplace violence to a local law-enforcement agency. After conducting the risk assessment, the measure requires the employer to provide mental health counseling or other appropriate resources to the offending employee and to take whatever steps necessary to protect its other employees and members of the public from future harm by the offending employee. The measure also applies to students enrolled at a public institution of higher education. The measure provides that an employer that fails to perform these duties shall be liable for any damages sustained thereafter by any individual as the result of any incident of workplace violence committed by the offending individual. The measure provides that the failure of a public employer to perform these duties constitutes a waiver or relinquishment of any sovereign immunity to which the public employer is otherwise entitled.
