19100244DBe it enacted by the General Assembly of Virginia:
1. That § 55-248.51 of the Code of Virginia is amended and reenacted as follows:
§ 55-248.51. Penalties for violation of chapter.
If the landlord acts in willful violation of §§ § 55-248.43, 55-248.45,
55-248.47 or §
55-248.50 or if the landlord fails to provide a written, dated lease, the
tenant is entitled to recover from the landlord an amount equal
to the greater of either three times
the tenant's monthly rental payment at the time of the violation, or actual damages and reasonable
attorney's attorney fees.
