AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to require the State Board of Social Services to amend its regulations regarding bed limits for licensed assisted living facilities.

Be it enacted by the General Assembly of Virginia:

1. § 1. That the State Board of Social Services shall amend its regulations to exempt from the requirement that no more than two residents reside in a bedroom as set forth in 22VAC40-73-900 (i) any assisted living facility licensed as of February 1, 2018, and (ii) any assisted living facility located in a building that was occupied by an assisted living facility described in clause (i), provided that no intervening assisted living facility occupied such building between the occupancy of the assisted living facility described in clause (i) and the assisted living facility seeking exemption from the bed limit set forth in 22VAC40-73-900.
