19103549DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 22.1-273.3 as follows:
§ 22.1-273.3. Counseling services; parental rights.
A. No student shall be required to receive personal or social counseling services without written parental consent.
B. The parent of a student may, at his sole discretion, be present at any personal or social counseling service in which his child is required to participate.
C. A school shall send a written notification, for each instance a student is required to receive personal or social counseling services, to parents about (i) the services that are scheduled for the student, (ii) the purpose and general description of the services, (iii) ways parents may review materials to be used, and (iv) the procedures by which parents may be present or limit or prohibit the student's participation.
D. The provisions of this section shall not apply to a service provided to a student pursuant to his Individualized Education Program.
