C. During the period of the closure of a CCR unit and during the period of any recycling that occurs beyond such closure period, the owner of such CCR unit shall ensure that access to the operation of public facilities during regular operational hours of such facilities is not impeded.

That the State Corporation Commission shall not allow a public utility to recover from the retail electric customers of the state costs resulting from any unlawful discharge to the surface waters of the state from a CCR surface impoundment as defined in Article 2.7 (ยง 62.1-44.15:85 et seq.) of Title 62.1 of the Code of Virginia, as created by this act, unless the Commission determines that such discharge was due to a force of nature.
