SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

School boards; employment of certain individuals. Permits any school board to employ an individual who, at the time of the individual's hiring, has been convicted of a felony, provided that such individual (i) was employed in good standing by a school board on or before December 17, 2015; (ii) has been granted a simple pardon for such offense by the Governor or other appropriate authority; and (iii) has had his civil rights restored by the Governor or other appropriate authority. The bill permits a school board to employ, until July 1, 2020, a person who does not satisfy the conditions set forth in clauses (ii) and (iii), provided that such person has been continuously employed by the school board from December 17, 2015, through July 1, 2018. This bill is identical to HB 1000.

SUMMARY AS PASSED:

School boards; employment of certain individuals. Permits any school board to employ an individual who, at the time of the individual's hiring, has been convicted of a felony, provided that such individual (i) was employed in good standing by a school board on or before December 17, 2015; (ii) has been granted a simple pardon for such offense by the Governor or other appropriate authority; and (iii) has had his civil rights restored by the Governor or other appropriate authority. This bill is identical to HB 1000.

SUMMARY AS PASSED SENATE:

School boards; employment of certain individuals. Prohibits any school board from employing any individual who has been convicted of any felony offense against a child; a certain act of violence or violent felony; any offense involving the sexual molestation, physical or sexual abuse, or rape of a child; or any offense requiring registration with the Sex Offender and Crimes Against Minors Register Act. The bill provides that for any other felony offense, the school board, in its discretion, may hire an individual who has had his civil rights restored by the Governor and at least five years have passed since such conviction.

SUMMARY AS INTRODUCED:

School boards; employment of certain individuals. Prohibits any school board from employing (i) any individual who has been convicted of any felony offense against a child; a certain act of violence or violent felony; or any offense involving the sexual molestation, physical or sexual abuse, or rape of a child or (ii) any other individual who has been convicted of any other felony offense unless such individual has had his civil rights restored by the Governor and at least 5 years have passed since such conviction.
