Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.2-274.01 as follows:

§ 33.2-274.01. Electronic Routing Registry; penalty.

A. For the purposes of this section:

"Digital routing provider" means an entity that provides electronic routing services to the general public through use of computer-assisted navigation that reflects real-time traffic conditions.

"Eligible highway" means a highway that is a component of the secondary state highway system and is located in a residence district as defined in § 46.2-100.

"Through traffic" means vehicle traffic that is not being routed to a destination within one-half mile of an eligible highway.

B. The Department shall create and maintain an Electronic Routing Registry (the Registry) of highways, or portions thereof, where electronic routing of through traffic on designated highways is prohibited. Localities may designate eligible highways, or portions thereof, for placement on the Registry by ordinance, provided that no more than five percent of the secondary highway miles of such locality are included on the Registry. The Department shall publish the Registry on its website. Within six months of placement of a highway on the Registry, digital routing providers shall remove such highways from routing algorithms.

C. Nothing in this section shall apply to a digital routing provider providing services for a fee to (i) parcel delivery service providers or (ii) emergency personnel.

D. Any digital routing provider that violates this section is subject to a civil penalty of $500 for each day such digital routing provider is in violation. The Attorney General or any attorney for a locality shall have standing to enforce the provisions of this section and shall recover attorney fees and costs in any successful action.
