WHEREAS, the Department of Motor Vehicles operates Motor Carrier Service Centers to monitor trucks for compliance with state and federal statutes pertaining to size and weight of trucks using the highways in the Commonwealth; and

WHEREAS, the Department of Motor Vehicles has 13 permanent Motor Carrier Service Centers and 12 mobile crews located throughout the Commonwealth; and

WHEREAS, the mobile crews weigh vehicles using portable scales to monitor compliance with state and federal law; and

WHEREAS, in recognition of the fact that portable scales are less accurate than permanent scales, the Federal Highway Administration permits states to allow up to a five percent tolerance for weight violations when portable scales are used; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Department of Motor Vehicles be requested to study and develop best practices for allowing a tolerance for overweight truck violations when using portable truck scales.

In conducting its study, the Department of Motor Vehicles (Department) shall review the relevant statutes of other states, determine the relative reliability of portable and permanent scales, and assess the feasibility of allowing a tolerance for overweight truck violations when portable scales are used.

All agencies of the Commonwealth shall provide assistance to the Department of Motor Vehicles for this study, upon request.

The Department of Motor Vehicles shall complete its meetings by November 30, 2018, and shall submit to the Governor and the General Assembly an executive summary and a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports no later than the first day of the 2019 Regular Session of the General Assembly and shall be posted on the General Assembly's website.
