HOUSE BILL NO. 889 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee on Agriculture, Chesapeake and Natural Resources on February 7, 2018) (Patron Prior to Substitute--Delegate Orrock) A BILL to amend the Code of Virginia by adding a section numbered 3.2-6538.1, relating to tethering of dogs; local ordinance.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 3.2-6538.1 as follows:

§ 3.2-6538.1. Governing body of any locality may restrict tethering of dogs.

The governing body of any locality may by ordinance restrict the tethering of a dog outdoors, including by limiting the weather conditions or the maximum number of hours during which the dog may remain tethered. No such ordinance shall restrict normal hunting or agricultural activities.

2. That the provisions of this act shall not repeal, amend, impair, or affect any ordinance restricting or prohibiting the tethering of a dog outdoors that was adopted by the governing body of any locality prior to July 1, 2018.
