18100709DBe it enacted by the General Assembly of Virginia:
1. That § 2.2-523 of the Code of Virginia is amended and reenacted as follows:
§ 2.2-523. Confidentiality of information; penalty.
A. The Division shall not make public, prior to a public hearing pursuant to § 2.2-520, investigative notes and other correspondence and information furnished to the Division in confidence with respect to an investigation or conciliation process involving an alleged unlawful discriminatory practice.
B. Any informal determination made by the Division, prior to a public hearing held pursuant to § 2.2-520, as a result of an investigation or conciliation process involving an alleged unlawful discriminatory practice shall not be discoverable or admissible in evidence in any civil action.
C. Nothing in this section, however, shall prohibit the distribution of information taken from inactive reports in a form that does not reveal the identity of the parties involved or other persons supplying information.
