18102256DBe it enacted by the General Assembly of Virginia:
1. § 1. That the
Department of Conservation and Recreation, with approval of the Governor
pursuant to § 10.1-109 of the Code of Virginia, is hereby authorized to accept
from the Newman Living Trust the conveyance of two parcels of real property
measuring approximately 1.85 acres in total located on Natural Tunnel Parkway
in Scott County, south and east of the intersection of Natural Tunnel Parkway
and Glenita Fault Lane and more particularly described as Scott County Real
Estate Map I.D. Number 100 A 64, held by the Newman Living Trust by that
certain quitclaim deed recorded in Deed Book 545, Page 1420 in the office of
the Clerk of the Circuit Court of Scott County and measuring approximately 1.73
acres, and as Scott County Real Estate Map I.D. Number 100 A 65, shown by the
Scott County Tax Assessor as held by the Natural Tunnel Stone Co. and measuring
approximately 0.12 acres. The conveyance shall be made without consideration
and shall be made for the purpose of providing Natural Tunnel State Park with
additional property.
§ 2. That notwithstanding any other provision of law, including any provision to the contrary contained in a general appropriation act adopted by the 2018 Session of the General Assembly, the Department of Conservation and Recreation is authorized to accept the conveyance of these properties as contiguous to Natural Tunnel State Park.
§ 3. That the conveyance shall be made in a form approved by the Attorney General. The appropriate officials of the Commonwealth are hereby authorized to prepare, execute, and deliver such deed and other documents as may be necessary to accomplish the conveyance. Acceptance of the conveyance is subject to the Department of Conservation and Recreation obtaining appropriate environmental assessment(s) of the property satisfactory to the Commonwealth.
