18100318DBe it enacted by the General Assembly of Virginia:
1. That § 22.1-288 of the Code of Virginia is amended and reenacted as follows:
§ 22.1-288. Furnishing pupil information to public or private school or institution of higher education or Armed Forces of the United States or the Commonwealth.
A. Notwithstanding
§ 22.1-287, the principal of any public elementary or secondary school
may permit the furnishing of or may furnish (i) the
names and addresses of pupils presently or formerly enrolled or pupils who have terminated their enrollment
to any officer or employee of a public or private school or institution of
higher education or any
official of a private business or professional school or
institution of higher education or (ii) the names,
addresses, and telephone listings of
pupils presently or formerly enrolled to any official recruiting representative of the military forces Armed Forces of the Commonwealth and the
United States or the Commonwealth unless
the pupil or, if the pupil is less than 18 years of age, his
parent has submitted to the school board a written
request to opt out of such disclosures
to such recruiting representatives, in which case the
pupil's name, address, and
telephone listing shall not be furnished to such
a recruiting representative without the written
consent of the pupil or, if the pupil is less
than 18 years of age, his parent. This
information shall be furnished for the
B. The
purpose of informing
furnishing information pursuant to subsection A is to
inform pupils and former pupils of the educational and
career opportunities available in the institutions school, institution, or the military branch of the armed
forces to which such information is furnished.
C. No such public or private
school or,
institution of higher education or private business or professional
school or institution of higher education, or
official recruiting representative or the military force he
represents branch
of the armed forces shall use such information furnished pursuant to subsection A
for purposes not directly related to the academic or professional goals of the school, institution, or the
military force branch
of the armed forces. If any school or
institution or any
official representative or military force
violates the provisions of this section, the privilege of the
school, institution, or military force to receive the lists shall be suspended Any such entity that
uses such information for purposes not directly related to its
academic or professional goals is ineligible to receive any additional pupil
information for a period of two years from the time of
discovery of the misuse of such lists information.
