18103893DBe it enacted by the General Assembly of Virginia:
1. § 1. That, notwithstanding the provisions of § 32.1-102.3 of the Code of Virginia, the State Health Commissioner shall accept and review applications for and may issue, without a determination that a public need has been demonstrated, a certificate of public need subject to such conditions as the State Health Commissioner may deem appropriate in accordance with the provisions of § 32.1-102.4 of the Code of Virginia, for the establishment of and related medical equipment for a freestanding diagnostic imaging center located in the Town of Ashland that will provide diagnostic imaging services using magnetic resonance imaging (MRI) and computed tomographic (CT) scanning on an outpatient basis provided that the applicant operates a practice owned exclusively by physicians who (i) graduated from medical schools located in Virginia, (ii) are certified by the American Board of Radiology in Diagnostic Radiology, and (iii) are credentialed in over 25 hospitals.
