S.B. 84 Fleet vehicles; temporary registration, penalty. DMV may issue to fleet logistics providers

Temporary registration of fleet vehicles; penalty. Provides that the Department of Motor Vehicles may issue to fleet logistics providers, defined in the bill, a temporary registration for certain fleet vehicles. The bill requires that such temporary registration expire on receipt of permanent license plates from the Department or another jurisdiction, or 30 days from issuance, whichever occurs first.

Subdivision ordinance; pro rata share of certain road improvements. Adds the City of Chesapeake to those localities that may require payment by a subdivider or developer of land of a pro rata share of the cost of reasonable and necessary road improvements, located outside the property limits of the land owned or controlled by him but serving an area having related traffic needs to which his subdivision or development will contribute, to reimburse an initial subdivider or developer who has advanced such costs or constructed such road improvements. The City of Chesapeake appears to have been inadvertently dropped from this statute during a 2007 Code revision.

S.B. 213 Aircraft, public; definition

Public aircraft; definition. Provides that the definition of "public aircraft" includes any fighter or attack jet, defined in the bill, that is leased or owned by a private entity, provided that such aircraft is used exclusively for military combat training in service to the federal government. The bill specifies that no fighter or attack jet that is leased or purchased by a private entity and is used exclusively for military combat training in service to the federal government beginning September 1, 2010, shall be treated as a civil aircraft for purposes of Title 5.1 (Aviation). The bill has an expiration date of September 1, 2023.

S.B. 291 Motor Vehicles, Department of; electronic services.

Department of Motor Vehicles; electronic services. Codifies existing budget language in Item 442 A of the 2017 Appropriation Act that authorizes the Department of Motor Vehicles to establish, where feasible and cost efficient, contracts with public-private partnerships to provide for simplification and streamlining of services through electronic means. The bill codifies electronic services that the Department of Motor Vehicles has created pursuant to existing budget authority to provide simple, fast, efficient, and secure titling and registration of vehicles for customers and lienholders.

S.B. 359 Driver education courses; instructor qualifications.

Driver education courses; instructor qualifications. Provides that the Commissioner of the Department of Motor Vehicles (Commissioner) may, in lieu of the requirements established by the Department of Education for driver education instructor qualification, accept 20 years' service with any local police department by a law-enforcement officer who (i) retired or resigned while in good standing from such department, (ii) was certified through a criminal justice training academy, and (iii) has been certified to teach driver education by the Department of Criminal Justice Services. Current law only allows the Commissioner to accept 20 years' service with the Department of State Police by a person who retired or resigned while in good standing from such department in lieu of such requirements for driver education instructor qualification.

S.B. 621 Driver privilege cards; authorizes issuance of new cards by DMV.

Driver privilege cards. Authorizes the issuance of new driver privilege cards by the Department of Motor Vehicles to an individual who has (i) reported income from Virginia sources on an individual tax return filed with the Commonwealth in the preceding 12 months and (ii) is not in violation of the insurance requirements of Article 8 (§ 46.2-705 et seq.) (Registration of Uninsured Motor Vehicles) of Chapter 6 of Title 46.2. The bill provides that driver privilege cards shall confer the same privileges and shall be subject to the same provisions as driver's licenses and permits; however, driver privilege cards shall not (a) confer voting privileges, (b) permit an individual to waive any part of the driver examination, or (c) have their issuance be contingent upon the applicant's ability to produce proof of legal presence in the United States. The bill provides for the term "driver's license" to consistently refer to all driver's licenses, permits, driver privilege cards, and special identification cards issued by the Commonwealth or the comparable law of another jurisdiction. The bill allows the issuance of a limited-duration driver's license and special identification card to an applicant presenting valid documentary evidence that a federal court or federal agency having jurisdiction over immigration has authorized the applicant to be in the United States for a period of at least 30 days from the date of application. The bill authorizes the Tax Commissioner to provide to the Commissioner of the Department of Motor Vehicles information sufficient to verify that an applicant for a driver privilege card or permit reported income from Virginia sources on an individual tax return filed with the Commonwealth in the preceding 12 months. The bill has a delayed effective date of January 1, 2019.

Inspections prior to sale; exception; certain special orders. Exempts from the requirement that motor vehicles be inspected prior to retail sale transactions a motor vehicle that is sold on the basis of a special order placed with a dealer or manufacturer outside the Commonwealth by a dealer who makes modifications to such vehicle prior to delivery to the first retail customer who takes delivery outside the Commonwealth. The bill expands the existing exception for dealers who order from a manufacturer outside the Commonwealth on behalf of a nonresident of the Commonwealth to include orders made with another dealer outside the Commonwealth. The bill contains a technical amendment.
