SENATE BILL NO. SB 1223 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Transportation on January 25, 2017) (Patron Prior to Substitute--Senator Barker) A BILL to amend the Code of Virginia by adding a section numbered 46.2-905.1, relating to riding bicycle or electric power-assisted bicycle while intoxicated; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-905.1 as follows:

§ 46.2-905.1. Riding bicycle or electric power-assisted bicycle while intoxicated; penalty.

Any person operating a bicycle or electric power-assisted bicycle on a highway while intoxicated, whether willfully or not, and whether such intoxication results from self-administered alcohol or other drug of whatever nature, is guilty of a Class 1 misdemeanor.
