Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-905.1 as follows:

§ 46.2-905.1. Riding bicycle, electric personal assistive mobility device, electric power-assisted bicycle, and moped while intoxicated; penalty.

Any person operating a bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or moped on a highway while intoxicated, whether willfully or not, and whether such intoxication results from self-administered alcohol or other drug of whatever nature, is guilty of a Class 2 misdemeanor.
