17104417DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 2 of Chapter 12 of Title 46.2 a section numbered 46.2-1215.1 as follows:
§ 46.2-1215.1. Local governing body may regulate vehicles unattended and running.
The governing body of any locality may by ordinance provide that no person operating a motor vehicle shall permit such vehicle to stand unattended on a highway without first stopping the engine, locking the ignition, removing the key from the ignition, and either placing the vehicle in park, setting the emergency brake, or both.
Nothing in any such ordinance shall be construed to include any (i) firefighting vehicle, emergency medical services vehicle, rescue or life-saving vehicle, or vehicle used by police, firefighting, or rescue personnel; (ii) electrical service utility vehicle owned and operated by a public utility, as defined in § 56-265.1; (iii) commercial motor vehicle; or (iv) vehicle engine started by a remote starter or other similar device that remotely starts such engine without placing a key in the ignition.
