Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 9 of Title 65.2 a section numbered 65.2-904 as follows:

§ 65.2-904. Criminal penalties.

A. In addition to the civil penalties assessed pursuant to § 65.2-902, any employer who knowingly and intentionally fails to comply with the provisions of § 65.2-900 or dissuades or deters an employee from filing a claim under § 65.2-601 is guilty of a Class 2 misdemeanor.

B. Venue for the prosecution hereof when there is an injury shall lie in the county or city wherein the injury occurred.
