That the provisions of this act shall not become effective if prior to July 1, 2017, the U.S. Department of Labor grants to the Commonwealth a waiver of the State Board membership composition requirements under § 101(b) of the federal Workforce Innovation and Opportunity Act of 2014 (P.L. 113-128) that permits the membership of the Virginia Board of Workforce Development to continue to be composed as provided in § 2.2-2471 of the Code of Virginia as in effect on January 1, 2017.
