SUMMARY AS PASSED:
Local stormwater utility; public-private partnership. Authorizes the creation of public-private stormwater management programs, to be known as stormwater management private property programs, and adds contracting for the construction and operation of stormwater management facilities to the list of activities for which a local stormwater utility is authorized to recover charges.
SUMMARY AS PASSED SENATE:
Local stormwater utility; public-private partnership; waiver of charges to railroad right-of-way. Authorizes the creation of public-private stormwater management programs and adds contracting for the construction and operation of stormwater management facilities to the list of activities for which a local stormwater utility is authorized to recover charges. The bill also requires any locality adopting a system of stormwater service charges to waive charges to land located within a railroad right-of-way that is covered with ballast and rail.
SUMMARY AS INTRODUCED:
Local stormwater utility; waiver of charges; retention of water on site. Provides that a locality establishing a stormwater utility or service charge system shall waive charges to any real property that retains its stormwater on site and thereby permanently produces no stormwater flow or pollutant loading.
