SUMMARY AS PASSED:

Rights of persons with disabilities in public places and places of public accommodation; fraudulent representation of a service or hearing dog; penalty. Provides that any person who knowingly and willfully fits a dog with a harness, collar, vest, sign, or identification card commonly used by a person with a disability in order to represent that the dog is a service dog or hearing dog to fraudulently gain public access for such dog in a public place is guilty of a Class 4 misdemeanor.

SUMMARY AS PASSED SENATE:

Rights of persons with disabilities in public places and places of public accommodation; fraudulent representation of a service dog; penalty. Provides that any person who knowingly, willfully, and fraudulently fits a dog with a harness, collar, vest, sign, or identification card commonly used by a person with a disability in order to represent that the dog is a service dog to fraudulently gain public access for such dog in a public place is guilty of a Class 4 misdemeanor. The bill prohibits entities from requiring certification of a disability or the dog's training but, when it is not obvious what service a dog provides, allows an entity to ask (i) whether the dog is a service dog and (ii) what tasks the dog is trained to perform.
