SUMMARY AS PASSED:
Virginia Public Procurement Act; awards as a result of authorized enhancement or remedial measures. Requires any enhancement or remedial measure authorized by the Governor under subsection C of § 2.2-4310 for procurement by state agencies to include a compliance provision for the use of small, women-owned, minority-owned, and service disabled veteran-owned businesses certified by the Department of Small Business and Supplier Diversity. The bill requires that a contract be awarded in accordance with an award priority provided in such enhancement or remedial measure if such priority business participated in and met the requirements of the solicitation. If the contract cannot be awarded on this basis, the contract must be awarded to a qualified business in accordance with the next established award priority, and so on until a contract is awarded on the basis of an established priority. The bill provides that if no qualified priority businesses are participating, the procurement award may be made without regard to the enhancement or remedial measure.
SUMMARY AS PASSED HOUSE:
Virginia Public Procurement Act; certain set-aside awards; awards as a result of authorized enhancement or remedial measures. Requires that any program established under subsection B of § 2.2-4310 or any enhancement or remedial measures authorized by the Governor pursuant to subsection C of § 2.2-4310 provide that, in the event that a business fails to be awarded a contract under such program, the contract remains subject to the set-aside award priority for qualified small businesses and businesses owned by women, minorities, and service disabled veterans and certified by the Department of Small Business and Supplier Diversity.
SUMMARY AS INTRODUCED:
Virginia Public Procurement Act; certain set-aside awards. Provides that any program for the participation of small, women-owned, minority-owned, and service disabled veteran-owned businesses or any enhancement or remedial measures authorized by the Governor that includes the participation of micro-businesses in public procurement shall include a provision that in the event a micro-business fails to be awarded a contract, such contract remains subject to the set-aside award priority for qualified small businesses and businesses owned by women, minorities, and service disabled veterans and certified by the Department of Small Business and Supplier Diversity.
