SUMMARY AS PASSED HOUSE:
Institutions of higher education; law-enforcement agencies; response to sexual assault. Permits each public institution of higher education or nonprofit private institution of higher education to request the cooperation of the primary law-enforcement agency of the locality in which the institution is located to establish a written memorandum of understanding with such law-enforcement agency to address the prevention of and response to criminal sexual assault and requires such law-enforcement agency to cooperate in establishing such memorandum of understanding.
SUMMARY AS INTRODUCED:
Institutions of higher education; law-enforcement agencies; response to sexual assault. Requires each public and private institution of higher education to enter into and become a party to a memorandum of understanding with an adjacent local law-enforcement agency or the Department of State Police to address the prevention of and response to sexual assault and lists several permissible provisions for such memoranda of understanding. The bill also provides that the requirement to establish such memoranda of understanding shall not be construed to (i) require a campus police department or the law-enforcement agency with which it has established the memorandum of understanding to disclose identifying information about any victim of sexual assault or (ii) prohibit a campus police department from requesting assistance from any appropriate law-enforcement agency of the Commonwealth, even though a memorandum of understanding has not been executed with that agency.
