SENATE BILL NO. 702 Offered January 21, 2016 A BILL to provide that a bridge structure is not attached to the Cities of Chesapeake or Portsmouth; annual service fee. ---------- Patron-- Lucas ---------- Referred to Committee on Transportation ----------

Be it enacted by the General Assembly of Virginia:

1. § 1. Any bridge structure constructed and operated in accordance with the provisions of Chapter 581 of the Acts of Assembly of 2009 shall not be deemed to be within any locality to which it is attached pursuant to § 15.2-3105 of the Code of Virginia.

§ 2. In consideration for the impact that such bridge structure may have on the Cities of Chesapeake and Portsmouth as contemplated in § 1, the owners of the bridge structure shall pay an annual service fee to each city, on or before September 1. The annual service fee payable to each city shall be calculated as five cents per toll paid for vehicles using the bridge structure in aggregate during the preceding fiscal year beginning July 1, divided equally between the cities.

2. That the provisions of § 1 of the first enactment of this act are declaratory of existing law.
