Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 54.1-2963.3 as follows:

§ 54.1-2963.3. Treatment of Lyme disease.

When a patient has chosen to accept treatment in accordance with a clinical practice guideline maintained by the National Guideline Clearinghouse for the treatment of Lyme disease and has been informed of the risks and benefits of such clinical practice guideline, no health care provider shall be the subject of a health regulatory board investigation or hearing for the treatment of such patient for Lyme disease based on the election to follow such clinical practice guideline, absent gross negligence or willful misconduct.
