AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 22.1-268 of the Code of Virginia, relating to attorneys for the Commonwealth; prosecution of compulsory school attendance cases.

Be it enacted by the General Assembly of Virginia:

1. That § 22.1-268 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-268. Prosecution and jurisdiction for the trial of cases arising under article.

A. It shall be the duty of the attorneys for the Commonwealth of the several counties and cities to prosecute all cases arising under of alleged violations of this article by a parent.

B. For alleged violations of this article by a child alleged to be a child in need of services or a child in need of supervision as provided in Chapter 11 (§ 16.1-226 et seq.) of Title 16.1, either the attorney for the Commonwealth or, if the attorney for the Commonwealth declines, the division superintendent's designee may pursue proceedings against the child.

C. Juvenile and domestic relations district courts shall have exclusive original jurisdiction for the trial of such all cases of alleged violations of this article.
