AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to require the State Board of Health to promulgate regulations for the audio-visual recording of residents in nursing facilities.

Be it enacted by the General Assembly of Virginia:

1. § 1. The State Board of Health (the Board) shall promulgate regulations, by July 1, 2017, for the audio-visual recording of residents in nursing facilities. Such regulations shall include provisions related to (i) resident privacy, (ii) notice and disclosure, (iii) liability, (iv) ownership and maintenance of equipment, (v) cost, (vii) recording and data security, and (viii) nursing facility options for both nursing facility-managed recording and resident-managed recording. The Department of Health shall convene a workgroup that includes representatives of nursing facilities, advocates for residents of nursing facilities, and other stakeholders to make recommendations to the Board on such regulations and shall report its recommendations to the Board and the General Assembly by December 1, 2016.

2. That Chapters 674 and 682 of the Acts of Assembly of 2013 are repealed.
