Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-138.01 as follows:

§ 32.1-138.01. Requests for electronic monitoring.

No nursing facility shall refuse a request made by a resident who is capable of making an informed decision or, if a resident is not capable of making an informed decision, by his authorized representative for  [ electronic  audio visual  ] monitoring  [ at the resident’s cost  ] of such resident's  [ private  ] room.
