Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 4 of Chapter 2 of Title 33.2 a section numbered 33.2-280.1 as follows:

§ 33.2-280.1. Charging transponder fees.

The Department shall not, as a result of inactivity on the part of the holder of any electronic toll transponder, (i) charge maintenance fees for electronic toll transponders or (ii) require users to exchange their transponder for a different type.

2. That the provisions of this act apply to all electronic toll transponders, regardless of the date they were issued to an account holder.
