Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 23-234.2 as follows:

§ 23-234.2. Retention of physical evidence recovery kits.

Campus police departments shall retain and store physical evidence recovery kits for a minimum of two years in cases where the victim of the sexual assault elects not to report the sexual assault to law enforcement at the time of the collection of such evidence.
