WHEREAS, the Dulles Toll Road Permit and Operating Agreement is an agreement between the Department of Transportation and the Metropolitan Washington Airports Authority; and

WHEREAS, the Metropolitan Washington Airports Authority's Permit and Operating Agreement with the Commonwealth is for a period of 50 years; it began on November 1, 2008, and runs until October 31, 2058, at which time control of the toll road will revert back to the Commonwealth; and

WHEREAS, the Dulles Toll Road Permit and Operating Agreement allows for the Metropolitan Washington Airports Authority to set tolls on the Dulles Toll Road to fund improvement projects to the Dulles Corridor; and

WHEREAS, pursuant to the agreement, the Metropolitan Washington Airports Authority is constructing a project consisting of an extension of Metrorail through the Dulles Corridor; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Joint Commission on Transportation Accountability be directed to study the Metropolitan Washington Airports Authority's compliance with the Dulles Toll Road Permit and Operating Agreement.

In conducting its study, the Joint Commission on Transportation Accountability shall review the Metropolitan Washington Airports Authority's rights and obligations under the agreement, including its obligations to (i) segregate toll revenues from other Metropolitan Washington Airports Authority revenues; (ii) design, build, and participate in financing the Dulles Metrorail Project; (iii) design, build, and finance the other capital improvements to the Dulles Corridor with the Department of Transportation and regional plan approval; and (iv) set toll rates after public consultation.

The Office of the Clerk of the House of Delegates shall provide administrative staff support. The Division of Legislative Services shall provide legal, research, policy analysis, and other services as requested by the Joint Commission on Transportation Accountability. All agencies of the Commonwealth shall provide assistance to the Joint Commission on Transportation Accountability for this study, upon request.

The Joint Commission on Transportation Accountability shall complete its meetings by November 30, 2016, and the chairman shall submit to the Division of Legislative Automated Systems an executive summary of its findings and recommendations no later than the first day of the 2017 Regular Session of the General Assembly. The executive summary shall state whether the Joint Commission on Transportation Accountability intends to submit to the General Assembly and the Governor a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
