A BILL to amend the Code of Virginia by adding a section numbered 2.2-3707.02, relating to the Virginia Freedom of Information Act; meetings of local public bodies; public comment required.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-3707.02 as follows:

§ 2.2-3707.02. Meetings of local or regional public bodies; public comment period; agendas.

A. As used in this section:

"Local public body" means a public body as defined in § 2.2-3701 that performs functions in or for a single county, city, or town.

"Regional public body" means a public body as defined in § 2.2-3701 that performs functions in or for two or more counties, cities, or towns.

B. Upon taking up each agenda item, a local or regional public body shall afford a public comment period of at least three minutes per speaker on each such item.

C. A copy of any proposed agenda shall be made available to the public at the same time such agenda is furnished to the members of the public body holding the meeting. The proposed agenda shall be posted in the same locations required by § 2.2-3707 for providing meeting notices. Upon convening the meeting, the public body may, with the concurrence of a majority of the members present and voting, add items to or delete items from such proposed agenda.

D. Nothing in this section shall be construed to prohibit any local or regional public body from adopting rules, not inconsistent with the provisions of this section, necessary for the conduct of its meetings and the maintenance of order.
